Perplexity, the AI search company, built a web browser called Comet that can shop for users automatically. Instead of clicking through a website yourself, you can simply tell the AI agent what you want to buy, and it will search, compare, and complete the purchase for you.
Amazon was not happy about this. The company argued that Comet was violating a federal law about unauthorized computer access, and a judge agreed, blocking Comet from using logged-in Amazon accounts back in March.
But on appeal, the Ninth Circuit Court saw things differently. The judges ruled that it is the human users, not Perplexity itself, who are accessing Amazon's servers, so the company is unlikely to be found liable. As a result, the court overturned the injunction entirely.
What makes this case especially interesting is that the court openly admitted there is very little existing law on how to handle responsibility for AI agents. The judges called their decision narrow, and said that the law around agentic AI will surely keep changing in the years ahead.
